TERMINOLOGÍAS Y DEFINICIONES UTILIZADAS EN OBRA.

Estimadas fiscalizadoras, fiscalizadores, coordinadores de obras, residentes de obra para la correcta interpretación de todo lo que se escucha en los procesos de construcción se utilizan una serie de términos habituales y en ocaciones mal empleados, así también definiciones de algunos conceptos y expresiones con características específicas de uso.
Terminología
AUMENTO O DISMINUCIÓN DE OBRAS:
La modificación de las cantidades de obras previstas en el proyecto aprobado y contratado.
AUTORIDAD:La persona que es designada por el mandante para resolver sobre cada materia.
CONTRATISTA:La persona natural o jurídica que, en virtud del contrato respectivo, contrae la obligación de ejecutar una obra material.
CONTRATO:Convenio, cuyo valor legal se adquiere mediante protocolización ante un Notario por parte del ejecutor de la obra y a través del cual el contratista se obliga a ejecutar una obra o a prestar un servicio, bajo ciertas condiciones preestablecidas y a un cierto precio.
FISCALIZACIÓN:Conjunto de actividades y procedimientos de verificación y control, realizado por funcionarios, en representación del fisco, para cautelar el cabal cumplimiento de compromisos contractuales con terceros, con el fin de resguardar los intereses de la Institución.
ESPECIFICACIONES TÉCNICAS:Conjunto de características que deberán cumplir las obras, motivo del contrato, incluyendo normas sobre procedimientos de elaboración, exigencias a que quedan sometidos los materiales y pruebas de control que deben superar las diferentes etapas de fabricación.
INSPECCIÓN TÉCNICA DE LA OBRA ( I.T.O.):La o las personas que, nombradas en forma competente, asumen el derecho y la obligación de fiscalizar el cumplimiento de un contrato de construcción.
MODIFICACIÓN DE OBRAS:El reemplazo de parte de las obras contenidas en el proyecto original presentado por el mandante, por Obras Extraordinarias.
OBRAS EXTRAORDINARIAS:Las obras que se incorporen o se agreguen al proyecto original, pero cuyas características sean diferentes a las especificadas o contenidas en los antecedentes que sirven de base al contrato.
PARTIDAS:Cada uno de los ítems o subítem considerados en las especificaciones técnicas o en el presupuesto.
PLANOS DE DETALLES:Los diseños a escala adecuada para realizar la construcción de piezas o partes del proyecto contenido en los planos generales.
PLANOS GENERALES:Los diseños que indicando ubicación, formas y medidas, permitan un juicio completo de las obras por realizar, y a una escala conveniente para su correcta interpretación.
PRESUPUESTO DETALLADO:El presupuesto efectuado por el oferente sobre la base de las especificaciones, cubicaciones y precios unitarios previstos por él para su propio proyecto.
PROGRAMA DE TRABAJO:Es la ordenación cronológica, dentro del plazo del contrato, del desarrollo de las diversas etapas o partidas de la obra, sea que ellas deban ser ejecutadas en forma simultánea o sucesiva.
PROYECTO:Se entiende por Proyecto las bases administrativas, especificaciones técnicas, planos generales, presupuestos y/o cantidades de obras y planos de detalles oficiales que entrega el mandante, elaborados por éste o por terceros para ejecutar la obra.
RECEPCIÓN FINAL:Es la verificación del cabal cumplimiento del contrato que realiza la Comisión Receptora designada para tal efecto.
Aunque ya en blog anteriores hemos ya revisado varias terminologías, me parece importante repetir o refrescar la memoria. En las tomas de decisiones y en la aplicación de la autoridad, no podemos cometer errores en nuestro lenguaje, un refrán muy conocido " pan al pan y vino al vino" el uso adecuado de los conceptos es inicio claro de las terminologías.

TERMINOLOGIES AND DEFINITIONS USED ON THE WORK.
Dear auditors, auditors, works coordinators, construction residents, for the correct interpretation of everything that is heard in the construction processes, a series of common terms are used and sometimes misused, as well as definitions of some concepts and expressions with characteristics specific to use.
Terminology
INCREASE OR DECREASE OF WORKS:
Modification of the quantities of works provided for in the approved and contracted project.
AUTHORITY: The person who is designated by the principal to resolve on each matter.
CONTRACTOR: The natural or legal person who, by virtue of the respective contract, contracts the obligation to execute a material work.
CONTRACT: Agreement, whose legal value is acquired by means of a notarization before a Notary Public by the executor of the work and through which the contractor is obliged to carry out a work or to provide a service, under certain pre-established conditions and at a certain price.
AUDIT: Set of verification and control activities and procedures, carried out by officials, on behalf of the Treasury, to ensure full compliance with contractual commitments with third parties, in order to safeguard the interests of the Institution.
TECHNICAL SPECIFICATIONS: Set of characteristics that the works must meet, the reason for the contract, including standards on preparation procedures, requirements to which materials are subjected and control tests that must pass the different manufacturing stages.
TECHNICAL INSPECTION OF THE WORK (I.T.O.): The person or persons who, named in a competent manner, assume the right and the obligation to supervise the fulfillment of a construction contract.
MODIFICATION OF WORKS: The replacement of part of the works contained in the original project presented by the client, by Extraordinary Works.
EXTRAORDINARY WORKS: The works that are incorporated or added to the original project, but whose characteristics are different from those specified or contained in the antecedents that serve as the basis for the contract.
ITEMS: Each of the items or subitems considered in the technical specifications or in the budget.
DETAIL DRAWINGS: The designs on an adequate scale to carry out the construction of pieces or parts of the project contained in the general plans.
GENERAL DRAWINGS: Designs that indicate location, shapes and measurements, allow a complete judgment of the works to be carried out, and at a convenient scale for their correct interpretation.
DETAILED BUDGET: The budget made by the bidder based on the specifications, measurements and unit prices provided by him for his own project.
WORK PROGRAM: It is the chronological ordering, within the term of the contract, of the development of the various stages or items of the work, whether they must be executed simultaneously or successively.
PROJECT: A Project is understood to be the administrative bases, technical specifications, general plans, budgets and / or quantities of works and official detail plans delivered by the client, prepared by the client or by third parties to carry out the work.
FINAL RECEPTION: It is the verification of the full fulfillment of the contract carried out by the Receiving Commission designated for this purpose.
Although we have already reviewed several terminologies in previous blogs, I think it is important to repeat or refresh my memory. In decision-making and in the application of authority, we cannot make mistakes in our language, a well-known saying "bread to bread and wine to wine" the proper use of concepts is a clear beginning of terminologies.
